Terms of Service
Effective date: August 26, 2026
These terms govern your use of the websites, web applications, browser extensions, and other software or services that Whatsoever LLC (“Whatsoever,” “we,” “us”) offers now or later under the Whatsoever name (together, the “Services”). By creating an account or using the Services, you agree to these terms. If you do not agree, do not use the Services.
Who we are
Whatsoever is software for namers. We provide tools that help you run a naming process — briefs, ideation, shortlisting, screening, and presenting candidates. We are not a law firm, and we do not practice law.
The Services
The Services include workflow tools and lookups that may surface third-party data, such as United States Patent and Trademark Office (USPTO) records and web search results. Those lookups are preliminary screening to help you gather information. They are incomplete, may be out of date or incorrect, and do not cover every class, jurisdiction, or kind of conflict.
Not legal advice
Nothing in the Services is legal advice, a legal opinion, or a trademark clearance search. Using the Services does not create an attorney–client relationship with Whatsoever or with anyone whose data appears in the Services.
Ratings, flags, and similar judgments in a project are yours — not ours. You are responsible for how you interpret screening data and for decisions about names. Hire qualified legal counsel before adopting, using, or registering a name.
Accounts and acceptable use
You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. Do not misuse the Services, attempt to access them without authorization, interfere with their operation, or use them to violate law or the rights of others.
Your content
You retain ownership of the briefs, ideas, notes, ratings, and other material you submit (“Your Content”). You grant us a limited license to host, process, and display Your Content as needed to operate the Services, including sharing it with people you invite or with anyone you give a summary link. You represent that you have the rights needed to submit Your Content.
Third-party services and data
The Services rely on third parties for authentication, hosting, payments, analytics, email, artificial intelligence, and search or lookup features, including USPTO data. That information is provided by those parties, not by us, and is offered as-is. We are not responsible for third-party sites, APIs, or records, or for decisions you make based on them.
Disclaimer of warranties
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that screening results are complete or accurate.
Limitation of liability
To the fullest extent permitted by law, Whatsoever and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Services or from any name you consider, recommend, or adopt. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve months before the claim, or one hundred dollars, whichever is greater.
Changes
We may update these terms from time to time. The effective date at the top is the source of truth. Continued use of the Services after a change means you accept the updated terms.
